A major online debate has erupt­ed over the U.S. cit­i­zen­ship sta­tus of Don­ald Trump’s chil­dren fol­low­ing his renewed efforts to repeal birthright cit­i­zen­ship. In Jan­u­ary, the for­mer pres­i­dent, now in his sec­ond term, signed an exec­u­tive order aimed at end­ing this con­sti­tu­tion­al right, and reports indi­cate the pol­i­cy might be imple­ment­ed in cer­tain states by the end of July. Birthright cit­i­zen­ship, estab­lished by the 14th Amend­ment, ensures that almost any­one born on U.S. soil auto­mat­i­cal­ly becomes a cit­i­zen, regard­less of their par­ents’ legal sta­tus.

The 14th Amend­ment clear­ly states that all per­sons born or nat­u­ral­ized in the U.S. are cit­i­zens. Trump’s exec­u­tive order would require chil­dren to have at least one par­ent who is either a U.S. cit­i­zen or a legal per­ma­nent res­i­dent to qual­i­fy for cit­i­zen­ship at birth. This pol­i­cy pri­mar­i­ly tar­gets chil­dren of undoc­u­ment­ed immi­grants and those on tem­po­rary visas, form­ing part of Trump’s broad­er strat­e­gy to reduce ille­gal immi­gra­tion across the coun­try.

Despite the order being signed ear­li­er in the year, birthright cit­i­zen­ship laws remain unchanged as of July 4. How­ev­er, a recent Supreme Court rul­ing on June 27 lim­its the abil­i­ty of low­er courts to block fed­er­al poli­cies nation­wide, poten­tial­ly allow­ing Trump’s order to progress more eas­i­ly in states not active­ly chal­leng­ing it. Still, the order faces legal hur­dles before it can be enact­ed nation­al­ly.

As the order gains trac­tion, social media users have turned atten­tion toward Trump’s own chil­dren. Crit­ics point­ed out that his first wife, Ivana, and cur­rent wife, Mela­nia, were not U.S. cit­i­zens at the time their chil­dren were born, rais­ing ques­tions about con­sis­ten­cy and fair­ness

How­ev­er, oth­ers have clar­i­fied that Don­ald Trump, as a U.S. cit­i­zen, was the father of all the chil­dren in ques­tion, and both Ivana and Mela­nia held green cards at the time of their children’s births. There­fore, under Trump’s pro­posed changes, his chil­dren would still qual­i­fy for U.S. cit­i­zen­ship, despite the ongo­ing online con­tro­ver­sy and scruti­ny.
